Udupi: Lokpal Bill will degrade constitutional position

Udupi, 25 October 2011: If we have to maintain the supremacy of the constitution, then the Janalokpal Bill should not be implemented, opinioned Bangalore University Law Department Professor Venkatesh. He was presenting a lecture during a felicitation function in Udupi on Saturday, on the subject ‘Constitution and the fight of Hazare’ conducted by Dalit Sangarsha Samiti.
He said that the plot is going on to degrade the constitution to second place and above that the establishing of the self governing Lokpal Bill, he accused. This bill will give provision to control the judiciary, executive and governing systems, so this is against our country’s democratic system, he justified his argument.
Our Prime Minister is the representative of our country in the International level. If PM is brought under the Lokpal Bill the position of the country’s representative will be lowered in International level and naturally the country’s position will get lowered. If the Supreme Court Judge is brought under this bill then there is fear of the judiciary system getting upset, he said.
Though there is no question on the honesty of Anna Hazare and his team, there is no guarantee that the members of this committee coming after them in the future will be honest. If the current anti corruption law is properly implemented then that itself will be enough and there is no need of this Lokpal bill, he argued.
On this occasion State Lawyers Association Vice President Shrinivasa Babu was felicitated by Dr. Premadasa Karkala. Association member Subhash Kowdichar was on the dias. G. Rajashekara presided over the program. District Convener Jayan Malpe gave introductory speech. Saraswathi Teacher welcomed the guests. Dinakara Bengre compeered the program.

Can this same professor who is about 50yrs age suggest a solution for curbing the bribery? In these 50 years did he ever suggest any plans to stop corruption? Then why spoiling somebody s good intention? So many years living like swines still we want to be in same stage. After the Anna s agitation atleast to some extent officers are capable to catch some culprits. What this hypocrite sort of professor want to prove by speaking like this? | |

Constitution is not supreme, people are. People through its elcted representatives have amended the constituion several times, removed some of the amendments, and will do so in the future. It is argued that basic structure cannot be changed, but what if mood of the nation changes? During sixties till eighties, mood of nation was nationalistic and socialistic. It changed to be regionalastic, due to which local governance became law since mid-nineties. Now, the mood is public distrust of officilas and elected representatives, especially due to corruption in public and private life of those weilding power. So why not a strong Lok Pal? Let the nation debate and decide, taking its time. | |

I partly agree with the views of the group. there are laws which are sufficient to control the ills including corruption. If anLokayukta acts are inmplemented and timely corruption could be reduced.Janalokapal is for higher cadres who are not covered in these laws. Let parliament take its course in a procedural manner so that the Act is not challeged in Court. |
