Yeddyurappa Government scores victory in the confidence vote in the Karnataka Assembly

Bangalore, 11 October 2010:  In a dramatic course of events and unprecedented commotion and confusion in the Karnataka  Assembly, on the morning of Monday, 11th October 2010  the much troubled BJP Government eventually succeeded in winning the  confidence motion passed by voice vote.

 

Prior to the trial of strength on the floor of the Assembly for the BJP-led government, Speaker KG Bopaiah disqualified 11 dissident BJP MLAs and five independents. In his order, Speaker Bopaiah said these 16 MLAs had been disqualified under the provision of the anti-defection law as envisaged in the Tenth Schedule of the Constitution. With this disqualification, the numbers were favourable for the  BJP Government to pass the crucial floor test.

 

 

 As the MLAs violently protested against their disqualification,  the police had to be summoned to maintain law and order within the Assembly. It is reported that the disqualified MLAs, especially the Independents, are also said to be seeking legal help.

 

The arithmetic of the Assembly works out as the follows after the disqualification of the dissidents.

Total: 208, 
Halfway: 104,  
BJP: 105, 
Congress: 73, 
JD(S): 28, 
Independents: 1

 
 
By disqualifying the dissidents, the Speaker, Bopaiah brought down the strength in the 224-member Assembly to 208. The ruling party strength reduced to 105 from 117 and the opposition Congress and JD(S) had a combined strength of 101 (Congress 73 and JD(S) 28). So, BJP was in position to pull through (Half way mark now being 104).

 

The Speaker’s move came after a big confrontation between him and Governor HR Bharadwaj who had  directed the Speaker not to disqualify any rebel MLA before the floor test on Monday.

 

The Governor and the Speaker traded letters and charges after Governor HR Bharadwaj stepped in to indicate the Speaker, KG Bopaiah, should not disqualify the rebel MLAs in order to maintain the character and configuration of the House.

 

The Governor had yesterday shot off an advise under Article 175 (2) of the Constitution, asking the Speaker not to change the character of the House and ensure that all members participate in the trial of strength.

 

Meanwhile, former Karnataka Chief Minister and JD(S) leader H D Kumaraswamy, who is spearheading the oust BJP government campaign reacted sharply to the disqualification charging that the BJP government has adopted "anti-democratic" methods to survive in power.

 

It has been  a week full of drama in Karntaka politics with the rebel MLAs city hopping late last night; two chartered planes brought back the MLAs to Bangalore, they are being closely guarded by JD(S) chief HD Kumaraswamy.

 

The Speaker had given the rebels a deadline of 5 pm on Sunday, 10th October 2010 to reply to the  notice he had issued to them. They ignored that deadline and stayed in Chennai where they met once again with JD (S) leader HD Kumaraswamy.

When Siddaramiaha, being a opposition leader in Karnataka assembly is stopped by Shankar Bidari,he can question the police cop to allow him to enter the Assembly hall. Shankar Bidari may be the city police chief but according to the legal constitutional rights, police are not allowed to enter Vidhana Soudha since Vidhana Souda has its own Police men inside the Assembly Hall.Never in the history of Karnataka has the Police entered the assembly hall.It is all because of Govt.supported puppet Speaker and shameful CM for the fear of shortage of MLAs to prove the majority.Today Democracy has died in Karnataka and the Speaker has become a puppet of Yediyurappa.How can the Speaker disqualify the members just few hours before the session and at the same time he can not disqualify the independant members when they won the election without BJP symbol.When Governer has the capacity to ask the CM to prove the majority on the floor and at the same time he has the capacity to recommend the Union Govt to impose the President Rule when the present Yediyurappa has no enough members to prove his majority.Best thing is to impose the President Rule in Karnataka.

Managing distribution of spoils of power is not easy, especially, for a party that is led by a man in the opposition for nearly a lifetime. The Congress has probably learnt the art over the years and is better placed on this score. The electorate is watching and it knows how to take charge. What a sad day for Karnataka! When, in one part of Bengaloru the national cricket team is trying to win the second test against all odds with fair-play and gentleman-ship, in another part of Bengaluru the ruling party tried to cling to power employing unconstitutional and dirty tricks. Whatever respect I had for the party and the CM disappeared in no time. Without A. B. Vajapaye BJP looks like a bunch of dacoits from Chambal valley. God save this beautiful state.

All are equal and want to milk the cow. Money power is dancing in Karnataka and everyone is looking for power to fill up the coffers. If you keep a lot out of it, they are bound to retaliate - irrespective of the party. See these are politicians, and they have only got a few prime years. Their aim is to dig deep and sell the entire mineral such that entire of Karnataka reduces in ground level from above to below the sea-level, in shame. And the leader remains busy with witchcraft.

This is so shameful! The CM is all the time busy taking care of his own seat and just wants power. The BJP Govt should be ashamed. With so many tainted ministers and the CM himself is leading the show by being an example of a tainted person! Look at the fate of the state the country. Is this the independence which we wanted and was given for?

The Speaker has no morality to disqualify 6 independents as they won the last election on their own symbols.And moreover it is illegal to disqualify those 11 BJP rebels just 4 hrs earlier to the confident of motion without proper legal procedure.The Speaker has acted as a agent of BJP Govt.BJP people says Governor is the agent of Central Govt. Ok what about the Speaker? He is also a agent of Yediyurappa.

I am not a supporter of the BJP much less the JD(S) father-son duo - Deve Gowda and Kumarswamy. When it comes to playing dirty no one political party in India including the Congress, RJD, JD(U) etc etc are any better. The Indian Constitution was not scripted for such rogues in politics. No Constitution in the world can handle such unscrupulous persons. The 13 BJP MLAs abducted could well be disqualified after a whip was issued. But no whip was issued. The 5 independent MLAs could not have been disqualified by the Speaker and should have been allowed to vote. Would that have upset the BJP s game plan of garnering a majority? The Governor had no business to poke his nose in legislative matters. If he had the conviction he should have recommended Presidents rule without calling for a test in the assembly. The rest would have been up to Delhi. Was these some Wolves in Sheeps clothing amongst the BJP MLAs who would have voted against the motion if put to a head count. Anyway Yeddi s days are numbered.

Governer has no morality.He has no right to call speaker to maintain status quo.Speaker did right thing .these rebels joined withJDS at chennai it self is clear proof of defection and did against party.In what way Mr DKS and HDS are less corrupt?.Governor is acting as agent for congress first he must be ousted by the president to safe guard democracy.

The proceedings of the assembly are illegal. For what reasons the speaker has disqualified 6 indepents? what breach they have committed? They are independent and they can individually support any party they like. Speaker cannot take action nor any party. If they violate any rule of the house in the house the speaker can suspend them for the day or for certain days.Therefore BJP has by illegal way said they have majority. The oppoding 11 MLAs of BJP are managed to be disqualified just before the commencement of the proceedings is illegal. Speaker has acted beyond his powers. He is not fit to continue as speaker. He has disgraced the house. The position of strngth should be as on the day of issuing notice. Hence Cong-73; JDS-27; descendint/oposing BJP-17 and Independent-6 is more than the BJP MLAs supporting BSY. Hence Cm has to resing if he has any principle, sense , ethics or belief in God. If not, he is not a man of any reason,a leader. In the circumstances what ex PM H.D. Devegouda once called him is idiot? He knows not what he does for the sake of power and damaging the image of BJP. It is disgrace for people of Karnataka to have such a CM.
